Terms of Sale

These terms apply to all containers supplied by Modulrkargo (Modulrkargo Pty Ltd, ABN [ABN]). By accepting a quote from us, you agree to these terms.

1. Quotes and pricing

Prices shown on this website are indicative and exclude delivery. A binding price is only established once we issue you a written quote. Quotes are valid for [NUMBER] days from the date of issue.

Prices are quoted in Australian dollars and include GST. The price shown is the price you pay for the container; delivery is calculated from your postcode and shown separately before you confirm an order.

About our 20% pricing claim: our advertised prices are set at 20% below [DEFINE THE REFERENCE BENCHMARK PRECISELY — e.g. "the average advertised price for an equivalent container across the five largest Australian suppliers, sampled monthly"]. [This definition must be accurate and substantiable. Under the Australian Consumer Law, a comparative or "was/now" price claim you cannot evidence is misleading conduct and attracts penalties. Retain the underlying market data.]

2. Payment

Payment terms are [e.g. 30% deposit on order, balance cleared before dispatch]. Title in the container does not pass to you until we have received payment in full. Risk passes to you on delivery.

3. Container condition

New (single-trip) containers have completed one cargo voyage and are in near-factory condition. Used containers show cosmetic wear including surface rust, dents and repainting, and are supplied as wind and watertight. Photographs on this website are representative; the container you receive will match the stated grade but will not be visually identical to the image shown.

You are encouraged to inspect any used container at our depot before purchase.

4. Delivery and site access

Delivery is quoted separately based on your location. Estimated timeframes are [e.g. 5–10 business days metro, 10–15 business days regional] from order confirmation and are estimates, not guarantees.

You are responsible for ensuring the delivery site is suitable, including that:

• the ground is firm and level and can carry the container's weight;
• there is at least 3 metres of clear overhead height and adequate room for the truck to manoeuvre;
• any permits, approvals or body-corporate consents required to place a container at the site have been obtained; and
• someone is present to accept delivery at the agreed time.

If delivery cannot be completed because the site is unsuitable or access is obstructed, a failed-delivery fee of [AMOUNT] applies and redelivery is charged at the standard rate.

5. Warranties and your consumer rights

New containers include a [12-month] structural warranty. Used containers are supplied with wind and watertight certification at the time of dispatch.

Nothing in these terms excludes, restricts or modifies the consumer guarantees that apply under the Australian Consumer Law. Where those guarantees apply, our goods come with guarantees that cannot be excluded: you are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.

6. Cancellations and returns

An order may be cancelled at no cost at any time before the container is dispatched. Once it has been loaded for delivery, transport costs already incurred are payable.

After delivery, stock containers may be returned within 30 days, subject to a 15% restocking fee. Full conditions, and how this interacts with your consumer guarantee rights, are set out in our Returns Policy. Nothing in that policy limits the rights described in clause 5.

7. Modifications

Modification work is quoted separately and is non-refundable once commenced. Modified containers may not be returnable. Indicative timeframes are 3–5 days for simple modifications and 2–4 weeks for fit-outs involving electrical work or insulation.

8. Liability

Subject to clause 5, our liability for any claim is limited to [e.g. the price paid for the container]. We are not liable for loss of profits or other indirect loss.

9. Governing law

These terms are governed by the laws of New South Wales, Australia.
